What damages are available under the FMLA?

Under the Family and Medical Leave Act, referred to as the FMLA, there’s several category of damages that you may be able to recover as a result of your lawsuit. Those damages include back wages, also reinstatement to your prior position. If reinstatement is not a feasible remedy, you may be awarded front wages, and an additional category of damages under the FMLA is liquidated damages, which automatically double the amount of damages that you are entitled to. However, under the FMLA, you cannot be compensated for your emotional distress, and there’s also no punitive damages, but you can usually recover your attorney’s fees.
