What do I need to prove to win my employment discrimination case?

In order to win your employment discrimination case, you need to prove that you’ve been treated differently from other employees. Inequal treatment could be in the form of adverse employment action, for example, termination, demotion, reduction of a salary or transfer to an unfavorable location. Or, it could be more subtle. It could be certain verbal statements that are made to you or certain harassment that you’re experiencing. In addition, in order to win your employment discrimination case, you also must prove that you’ve been treated differently because you belong to one of the protected categories under the law, such as gender, sexual orientation, disability, age, pregnancy, et cetera. And you must also prove that your employer’s stated reasons for discriminating against you are actually pretext. If you can prove all of those elements, you should be able to win your employment discrimination case.
