What is the difference between a workers’ compensation claim and a workers’ compensation retaliation claim?

The main difference between a worker’s compensation claim and a worker’s compensation retaliation claim is this: when you have a worker’s compensation claim, you’re essentially telling your employer to take you to a doctor for treatment and to give you the benefits that the worker’s compensation law says that you need to get.



When you are making a claim for retaliation, that’s different. That means that you made the claim or attempted to make the claim and as a result your employer either fired you, coerced you, or intimidated you.
